ORDINANCE AMENDING RATES
FOR WATER AND SEWER UTILITY SERVICES
WHEREAS, increased costs of salaries, wages, employee benefits, debt
service, capital improvements and charges for purchase of potable water supply
have dictated an increase in the water and sewer service charges; and
WHEREAS, the herein defined rates are intended to defray deficits in
the operation of the water and sewer utility system;
NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough
of Woodbury Heights that the following subsections be and are hereby adopted as
amendments to the present schedule of water and sewer service charges effective
April 1, 2010;
§ 107-14(A)(1) Minimum water service fee of
Forty-Eight ($48.00) Dollars with an allowance of Nine Thousand (9,000) Gallons
of water used per quarter plus excess water usage fees at the following rates:

9,001 to 25,000 gallons $5.70
per thousand gallons
25,001 to 50,000
gallons $6.00
per thousand gallons
50,001 to 100,000
gallons $6.60
per thousand gallons
over 100,000 gallons $7.80 per
thousand gallons
§ 107-14(A)(3) The minimum service charge of Forty Dollars ($40.00) per quarter be and is hereby amended to reflect a minimum service charge of Forty-Eight ($48.00) per quarter with all other terms and provisions of this subsection to be saved from amendment or repeal.
§107-14(B)(1) The minimum water service fee of Eighty-Eight ($88.00)
Dollars per quarter with an allowance of Nine Thousand (9,000) gallons per
quarter of consumption. Service fees for
consumption in excess of Nine Thousand (9,000) gallons per quarter shall incur
services fees in accordance with the following schedule:

per thousand gallons

(1) In instances where more than one
tenant and/or user is supplied with water by one meter, each additional tenant
and/or user shall pay an additional charge of $48.00 per quarter as a minimum
service fee.
§107-14(C) This Section shall be amended to reflect a flat rate water service fee of
$48.00 per quarter.
§107-14(D)(1) Minimum water service fee of Eighty-Eight ($88.00) Dollars
per quarter with an allowance of Nine Thousand (9,000) gallons per quarter with
all excess usage greater than Nine Thousand (9,000) gallons per quarter at the
below listed rates:

(2) In instances where more than one
tenant or principal user is supplied with water by 1 meter, each additional
tenant or user shall pay an additional flat rate charge of Eighty-Eight ($88.00)
Dollars per quarter.
§107-14(E)(1) Amend to reflect a quarterly charges
as follows:

§92-2.(c) The Annual sewer service charge is amended to the sum of $580.00
per domestic equivalent unit.
BE IT FURTHER ORDAINED, as follows:
Repealer and Savings Clause: If any chapter, section, subsection or
paragraph of this Ordinance is declared to be unconstitutional, invalid or
inoperative, in whole or in part, such chapter, section, subsection or
paragraph shall, to the extent that it is not unconstitutional, invalid or
inoperative, remain in full force and effect and be saved from repeal with such
determination not to be deemed to invalidate the remaining chapters, section,
subsections or paragraphs of this Ordinance or the Ordinance amended
hereby.

The
foregoing Ordinance was introduced at a Regular Meeting of the Mayor and
